What is FGTS?
THE Severance Pay Guarantee Fund (FGTS) is a right of workers that aims to protect their interests in cases of unfair dismissal, serious illness, retirement and other specific situations.
Therefore, it is a financial reserve, which employers are required to deposit monthly on behalf of their employees with signed employment contracts.
In this way, its objective is to provide financial support to Brazilians who become unemployed for various reasons, so that they can continue to support their families.
This fund is made up of a percentage of the worker's salary, deposited in an account linked to his/her name, which remains blocked until one of the situations provided for by law for its withdrawal occurs.
How does FGTS work?
How the FGTS works is something that still raises many questions. But don't worry! Below, we'll explain exactly how it works.
Generally speaking, when you start to work with a signed contract, every month, your employer deposits a percentage of your salary into an account linked to your employment contract.
More specifically, this deposit is made into a Caixa Econômica Federal account, in your name.
However, the amount that accumulates over the years of work is retained and you can only withdraw it in certain situations.
Furthermore, it is also worth noting that even if you are away from work for some reason, this amount will continue to be deposited by the employer. These reasons for absence include, for example:
- Maternity and paternity leave;
- Work accidents;
- Completion of compulsory military service;
- Vacation;
- In the first 30 days of sick leave;
- In addition to other cases of paid absence.
What is the value of the FGTS?
The FGTS value corresponds to 8% of the worker's gross salary and the employer must make the deposit at the beginning of each month.
Despite this general rule, there are some exceptions. Just to illustrate, in the case of domestic workers, the percentage is 11.2% of gross salary.
Meanwhile, whoever employs a Young Apprentice, you must make a monthly deposit of only 2% of gross salary.
This amount is accumulated in the worker's linked account over the months, earning interest and undergoing monetary updates from time to time.
When is it possible to withdraw the benefit?
Above, we have already explained that you cannot withdraw your FGTS balance whenever you want. In fact, it can be withdrawn in several specific situations, which are established in accordance with art. 20 of Law No. 8,036 of 1990.
More specifically, this law provides that withdrawals can be made, for example, in the event of dismissal without just cause, termination of a fixed-term contract, retirement or serious illness.
In addition, it is also possible to withdraw FGTS when you are buying your own home. It is also possible to withdraw part of the amount available in the account annually, in the month of your birthday and on some other occasions.
How do I check my FGTS balance?
In short, the FGTS is an important benefit that can offer financial support for workers in times of need, guaranteeing a reserve for unforeseen situations, such as job loss, for example.
Therefore, knowing your rights regarding this benefit is essential to guarantee your financial security in the future.
